Terms and Conditions for OIIQ Prephub

Welcome to OIIQ Prephub ("the App," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our AI-powered interactive learning platform, including our website, applications, and related services (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Description of Service
   OIIQ Prephub is a preparatory tool designed to help nursing candidates familiarize themselves with the format and style of questions similar to those on the professional examination of the Ordre des infirmières et infirmiers du Québec (OIIQ). The Service uses artificial intelligence to generate clinical situations, questions, and educational content.
2. No Affiliation with OIIQ
   Disclaimer: OIIQ Prephub is an independent entity and is not affiliated with, endorsed by, sponsored by, or associated in any way with the Ordre des infirmières et infirmiers du Québec (OIIQ). All trademarks, service marks, and trade names of OIIQ mentioned in the Service are the property of their respective owners. The content generated by our Service is for educational and preparatory purposes only and is not official OIIQ material.
3. Beta Service & Limitation of Liability
   You acknowledge that the Service is currently provided as a "beta" version. This means the Service is still undergoing testing and development and may contain errors, bugs, or inaccuracies.
   No Guarantee of Success: Your use of the Service does not guarantee that you will pass the OIIQ professional examination or achieve any specific score. The Service is a supplementary study tool and not a substitute for formal nursing education, diligent study, or professional judgment.
   "As Is" Basis: The Service is provided "AS IS" and "AS AVAILABLE," without any warranties of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the content will be accurate, reliable, complete, or current.
   Limitation of Liability: To the fullest extent permitted by applicable law, OIIQ Prephub, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.
4. User Accounts and Responsibilities
   To use certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your account.
5. Subscriptions, Payments, and Refunds
   Subscriptions: Certain features of the Service may be available only through a paid subscription. Subscription fees are billed in advance on a recurring basis as specified at the time of purchase.
   Refund Policy: We offer a refund policy for users who are not satisfied with the Service. To request a refund, you must contact our support team via email at contact@oiiq-prephub.com within 14 days of your initial purchase or subscription renewal. Refund requests will be evaluated on a case-by-case basis. We reserve the right to deny a refund request if we detect abuse of the policy.
6. Data Privacy and Use
   We are committed to protecting your privacy and handling your data responsibly.
   Data Protection and Residency: We adhere to applicable data protection laws and regulations. We take measures to ensure that your personal data is stored and processed in compliance with data residency policies relevant to your jurisdiction where feasible.
   Use of Anonymized Data for Model Training: To improve the quality, accuracy, and variety of our AI-generated content, we use data generated through your interactions with the Service to train our machine learning models. All data used for this purpose is fully anonymized and aggregated. We remove all personally identifiable information (PII) such as your name, email, and user ID. The data we use for training relates only to the generated content (e.g., topics, questions, scenarios) and user performance metrics, without any link back to you as an individual. By using the Service, you grant us a perpetual, worldwide, non-exclusive, royalty-free license to use this anonymized data for the purpose of training and improving our AI models and Service.
7. Intellectual Property
   The Service and its original content (excluding content generated for individual users), features, and functionality are and will remain the exclusive property of OIIQ Prephub and its licensors. The content generated specifically for you during your use of the Service is licensed to you for your personal, non-commercial, educational use only. You may not sell, redistribute, or use the generated content for commercial purposes.
8. Acceptable Use Policy
   You agree not to use the Service:
   In any way that violates any applicable national or international law or regulation.
   To exploit, harm, or attempt to exploit or harm minors in any way.
   To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service.
   To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service.
9. Termination
   We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.
10. Changes to Terms
    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
11. Governing Law
    These Terms shall be governed and construed in accordance with the laws of Quebec, Canada, without regard to its conflict of law provisions.
